Terms of Service

Welcome to eLAAS! These Terms of Service (“Terms”) govern your access to and use of the eLAAS website (elaas.co) and our software, services, and related tools (collectively, “Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.
1. About eLAAS
eLAAS Pty Ltd (ACN 641153899) provides eLearning-as-a-Service solutions for blue-collar workers for organisations across Australia.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Australian law to use our Services. If you are using the Services on behalf of an organisation, you represent that you have authority to bind them.
3. Account Registration
To use certain Services, you may need to register an account. You agree to:
- Provide accurate and complete information.
- Keep your login credentials secure.
- Notify us immediately of unauthorised access.
You are responsible for activity on your account unless caused by our negligence.
4. Use of Services
You agree not to:
- Use the Services for unlawful, harmful, or abusive purposes.
- Attempt to reverse engineer, decompile, or tamper with our systems.
- Distribute viruses, spam, or malicious code via our Services.
- Infringe intellectual property or privacy rights.
We may suspend or terminate accounts that violate these Terms.
5. Intellectual Property
All content, trademarks, software, and technology underlying eLAAS Services remain the exclusive property of eLAAS Pty Ltd or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Services for your organisation’s internal purposes only.
6. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance or technical issues may cause temporary disruptions.
7. Disclaimers
- Services are provided “as is” without warranties of any kind (except those required under Australian law).
- To the maximum extent permitted by law, we disclaim liability for indirect or consequential damages.
8. Australian Consumer Law
Nothing in these Terms excludes your rights under the Australian Consumer Law. Where ACL applies, our liability is limited (at our option) to:
(a) re-supplying the Services; or
(b) paying the cost of re-supply.
9. Limitation of Liability
To the extent permitted by law, eLAAS is not liable for:
- Loss of profits, revenue, or data.
- Business interruption or indirect damages.
- Total damages exceeding the amount paid in the past 12 months.
10. Termination
You may cancel your account at any time by contacting support@elaas.co. We may suspend or terminate Services if you breach these Terms or for operational reasons, with reasonable notice.
11. Third-Party Links
Our Services may include links to third-party sites. We are not responsible for the content or practices of these sites.
12. Privacy
Your use of Services is also governed by our Privacy Policy.
13. Changes to Terms
We may update these Terms from time to time. Changes take effect when posted on elaas.co or notified to you. Continued use means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
